1. Agreement to Terms

By accessing or using TenderFeed ("the Service"), operated by TenderFeed Pty Ltd (ABN pending) ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

2. Description of Service

TenderFeed is a software-as-a-service platform that helps Australian small and medium enterprises discover, evaluate, and respond to government tenders. The Service includes AI-powered tender matching, eligibility analysis, bid template generation, and contract intelligence features.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

4. Subscription and Payment

Paid subscriptions are billed monthly in advance. Prices are in Australian dollars and include GST where applicable. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are available within 14 days of your first payment under our money-back guarantee.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Scrape, crawl, or use automated means to access the Service beyond the provided APIs
• Resell, redistribute, or sublicense access to the Service
• Submit false or misleading information to tender agencies

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate tender matches, eligibility assessments, and bid templates. This content is provided for informational and guidance purposes only. You are solely responsible for reviewing, verifying, and customising all AI-generated content before submission to any tender authority. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

7. Intellectual Property

The Service, including its design, code, algorithms, and content, is owned by TenderFeed Pty Ltd. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by law, TenderFeed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, business, or opportunities, arising from your use of the Service. Our total liability shall not exceed the amounts you paid to us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
